The Hearing of Malaga has acquitted the former mayor of Estepona Rosa Díaz of the continued crimes of trespass and fraud to the administration that was accused by the Prosecutor’s Office for alleged irregularities in the sale and adjudication of plots through municipal companies.
The Prosecutor’s office had requested that Diaz be given a 6-year prison sentence and special disqualification for employment or public office for ten years.
Judicial sources have informed Efe of the acquittal of the former mayor of the PP for some events that occurred between 2001 and 2002, when the City Council transferred different farms to two municipal companies that, according to the Prosecutor’s Office, were later sold by their liquidators to private developers at a price below the market price.
The resolution also acquits the liquidators of the municipal companies Servicios Estepona XXI and Planning Estepona XXI, Félix Domínguez -who was treasurer of the City Council- and the lawyer Francisco González.
The Public Ministry argued in its January 2015 brief that on the occasion of the properties contributed to the municipal companies, the defendants Rosa Díaz, Félix Domínguez and Francisco González they acted in concert to benefit two promoter companies.
The Chamber understands that “it is not possible to appreciate the concurrence of intent in the realization of administrative acts to favor the property adjudication process “.
